Fulton Debit Card Controls Terms and Conditions

1. Introduction.  These Fulton Debit Card Controls Terms and Conditions (the “Terms”) apply to your use of the Fulton Debit Card Controls feature (“Card Controls”) offered through the Fulton Bank, N.A. (“Fulton”) online banking site or Mobile Banking App (the “Site”).  Please read these Terms carefully.  By enrolling in or using Card Controls, you acknowledge and warrant that you understand and agree to be bound by these Terms. You further agree to comply with all instructional materials, technical requirements, and on-screen guides (“Documentation”) we disclose or make available to you in connection with Card Controls.  

2. Debit Card Controls Alerts and Controls.  Debit Card Controls allows you to set certain alerts and Controls on any consumer debit card, small business debit card, or Health Savings Account (“HSA”) debit card issued by Fulton.  To use Card Controls, you must enroll your debit card(s) through the Site.

Debit Card Controls offers the following alert and Controls features:

a. Card on/off setting. This feature allows you to turn your debit card “ON” or “OFF.” Turning your debit card OFF will prevent most types of transactions, such as purchases or withdrawals, from being processed through your debit card, or any digital card numbers linked to your debit card, until you turn the card back ON.  Turning your debit card OFF will not cancel or deactivate your card permanently.  

Turning your debit card OFF will not stop:

  • Previously authorized recurring transactions;
  • The posting of refunds, reversals, or credit adjustments to your account; or
  • Transactions using other cards linked to your deposit account.

     

Turning your debit card OFF is not a replacement for reporting your card lost or stolen. Contact us immediately if you believe that unauthorized transactions have been made.

b. Transaction limits.  You can set spending limits or automatically decline debit card transactions based on merchant category, transaction type, or location.  

c. Transaction alerts.  You can set up email, text message, or push notification alerts for debit card transactions based on merchant category, transaction type, or location.  To receive push notifications, you must enable notifications on your mobile device. 

Fulton may add, remove, or update the available Debit Card Controls alert and Controls features from time to time without notice.  

3. Availability of Debit Card Controls Features. Certain Card Controls functionality within the Site may not be available for all transactions or all cards.  ATM Cards and Business Debit Cards are not eligible for Card Controls. Availability may also be affected by your mobile provider’s coverage area.

Controls and alerts based on the location of the mobile device where the Mobile Banking App is installed or the location of the merchant where the card is being attempted for use may not apply appropriately to card-not-present transactions or transactions where the actual location of the merchant differs from the merchant’s registered address. 

Debit Card Controls settings may not carry over to any replacement debit cards you receive, such as for lost, stolen, or damaged card replacements.

There may be service disruptions or events beyond Fulton’s Controls that could adversely affect Debit Card Controls availability or functionality including, but not limited to, natural disasters, power outages, telecommunication system delays or outages, data plan service limitations, or any other service disruptions.  Such disruptions could result in a delay in receiving alerts, debit card transactions being approved or denied while a card is turned ON or OFF, or any other reduced availability or functionality of Controls or alerts related to debit card transactions.

4. Exclusion of Warranties. DEBIT CARD CONTROLS AND ANY RELATED DOCUMENTATION ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 

5. Your Responsibilities. Our provision and your use of Debit Card Controls does not relieve you of your responsibility to diligently monitor activity in your Fulton account(s), to promptly review account statements as they are made available to you, and to promptly report any errors or unauthorized transactions or lost or stolen debit cards or credit cards, according to the terms and conditions of the agreements governing your Fulton account(s).

6. Fees. There may be taxes and/or fees related to Debit Card Controls that are charged by your mobile provider.  You should contact your mobile provider for details.  In the future, Fulton may add or change the availability of Debit Card Controls features. Added features may incur fee(s), and you agree to any applicable fees as noted in the fee schedule associated with your Fulton deposits account.

7. Miscellaneous.

a. To the extent that these Terms conflict with applicable state or federal law, such state or federal law shall replace such conflicting terms only to the extent required by law. Unless expressly stated otherwise, the remainder of these Terms will remain in full force and effect.

b. To the extent there is a conflict between these Terms and the Online Mobile Banking Agreement, your deposit agreement, or other agreements applicable to your debit card(s), these Terms will apply.

c. Fulton may cancel or suspend your use of Debit Card Controls without notice at any time.

d. Please contact Fulton at 1.800.385.8664 with any questions or concerns related to Debit Card Controls, or to report a lost or stolen card. 

Card Management Additional Terms

The Card Center card management feature is offered by Fulton Bank, N.A. (referred to herein as “FB”, “us”, “we” or “our”) for use by FB cardholders (“You” or “Your”). The card management feature is intended to allow You to initiate certain payment card related activities for Your enrolled FB debit card(s) via the card management feature. Those activities may include the ability to but not limited to:

  • Register the card
  • Activate and deactivate the card
  • Set control preferences for card usage including location, transaction, and merchant types, spend limits, and card on/off (“Controls”)
  • Set alert preferences for card usage including location, transaction, and merchant types, spend limits, and declined purchases (“Alerts”)
  • Report Your card as lost or stolen
  • Review Your spending by merchant type and/or by month
  • View a list of merchants storing Your card information for recurring or card-on-file payments

     

The card management feature may enable access to FB and third parties’ services and web sites, including GPS locator websites, such as Google. Use of such services may require internet access and that You accept additional terms and conditions applicable thereto, including, with respect to Google maps, those terms and conditions of use found at http://maps.google.com/help/terms_maps. Html and the Google Legal Notices found at https://www.google.com/help/legalnotices_maps/, or such other URLs as may be updated by Google. To the extent the card management feature allows You to access third party services, FB and those third parties, as applicable, reserve the right to change, suspend, remove, limit, or disable access to any of those services at any time without notice and without liability to You.

You agree to allow us to communicate with You via push notification, SMS and/or email, with respect to the activities performed via the card management feature. Data fees may be imposed by Your mobile provider for the transmission and receipt of messages and Alerts.
FB reserves the right to send administrative and service notifications via emails and/or SMS messages to the email address and/or phone number provided upon enrollment in FB’s card management feature.

Availability/Interruption. You acknowledge that the actual time between occurrence of an event (“Event”) triggering a selected Control or Alert and the time the notification of such event is sent to Your mobile device (“Notification”) is dependent on a number of factors including, without limitation, Your wireless service and coverage within the area in which You are located at that time. You acknowledge that Notifications of Events may be delayed, experience delivery failures, or face other transmission problems. Similarly, selection of Controls and Alerts (collectively, “Commands”) are likewise affected by the same or similar factors and problems could arise with use of Commands. Notifications of Events may not be available to be sent to Your mobile device in all areas.

If You registered to receive Notifications to Your mobile device, the card management feature is available when You have Your mobile device within the operating range of a wireless carrier with an appropriate signal for data services. The card management feature is subject to transmission limitations and service interruptions. FB does not guarantee that the card management feature (or any portion thereof) will be available at all times or in all areas.

You acknowledge and agree that certain functionality with the card management feature may not be available for all transactions. Commands based upon the location of the mobile device where the card management feature is installed or the location of the merchant where the card is being attempted for use may not apply appropriately to card-not-present transactions or transactions where the location of the actual location of the merchant differs from the merchant’s registered address.

You acknowledge and agree that neither FB nor its third-party services providers (including the developer of the technology enabling the Notifications) are responsible for performance degradation, interruption or delays due to conditions outside of its control. You acknowledge that neither FB nor its third-party service providers shall be liable to You if You are unable to receive Notifications on Your mobile device in Your intended area. FB, for itself and its third-party service providers, disclaims all liability for: any delays, mis-delivery, loss, or failure in the delivery of any Notification; any form of active or passive filtering.
